1. Red Balloon Creative Ltd will only carry out work for the client when an order has been made by email, phone, mail or fax. An order is deemed to be a written or verbal contract between the client and Red Balloon Creative Ltd.

2. Red Balloon Creative Ltd can accept no responsibility for any copyright infringement caused by materials submitted by the client. The client shall indemnify Red Balloon Creative Ltd against any costs whatsoever in connection with the ownership of copyright or reproduction rights.

3. Any work undertaken for the client remains the property of Red Balloon Creative Ltd until full payment is received. Red Balloon Creative Ltd reserves the right to hold back completed work until payment is received.

4. Red Balloon Creative Ltd reserve the right to display a developer credit and link on any work completed for the client. The client agrees that any work completed by Red Balloon Creative Ltd may later be used for display in a portfolio.

5. Red Balloon Creative Ltd can accept no responsibility for down time of a client’s website due to a problem with the hosting provider.

6. If the client wishes to cancel work in progress at any point Red Balloon Creative Ltd reserve the right to invoice the client an amount Red Balloon Creative Ltd deem proportional to the amount of work already completed.

7. A deposit of at least 40% of the final fee must be made before work will commence. The remainder must be paid within seven days of completion; failure to do so may result in further administrative costs being passed onto the client. Should Red Balloon Creative Ltd be waiting for an extended period of time for the content after completing the design they reserve the right to send the invoice for the final balance early.

8. Red Balloon Creative Ltd can accept no responsibility if a search engine or directory choose not to list the client’s website.

9. Red Balloon Creative Ltd make every effort to design websites which display acceptably in current popular internet browsers, but cannot accept responsibility should websites not display correctly if new browsers versions released after the work is completed.

10. The client agrees that changes required over and above the estimated work or required to be carried out after acceptance of the draft design will be liable to a separate charge.

11. Once web design is complete, Red Balloon Creative Ltd will provide the client with the opportunity to review the resulting work. Red Balloon Creative Ltd will make one set of minor changes at no extra cost within 14 days of the start of the review period. Minor changes include small textual changes and small adjustments to placement of items on the page. It does not include changes to images, colour schemes or any navigation features. Any minor changes can be notified to Red Balloon Creative Ltd by e-mail or by phone.

The placement of an order for design and/or any other services offered by Red Balloon Creative Ltd constitutes acceptance of the estimate or quotation and agreement to comply fully with all the Terms and Conditions and forms a Contract for Business between the signatory and Red Balloon Creative Ltd.
